These terms and conditions apply to the use of jbhalal.co.uk and to any orders placed through the website.

1. About us and how to contact us

1.2. By using our site and placing an order, you confirm that you are legally capable of entering into binding contracts.

2. Our Products

2.1. The images of the products on our site are for illustrative purposes only. Although we make every effort to display colours accurately, we cannot guarantee that your device accurately reflects the colour of the products. Your products may vary slightly from those images.

2.2. Although we make every effort to be as accurate as possible, because some of our products may be prepared, packed or cut to order, all sizes, weights, capacities, dimensions and measurements shown on our site may vary slightly. Where stated measurements apply, a tolerance of up to 5% may apply.

2.3. The packaging of the products may vary from that shown in images on our site.

2.4. All products shown on our site are subject to availability.

2.5. If an item in your order is unavailable, we may contact you to offer a reasonable substitute. We will not send a substitute without giving you the option to refuse it.

2.6. Product descriptions, ingredients and other details are provided as accurately as possible, but may occasionally change. If you have any allergy, intolerance, dietary or other product-related concern, please contact us before placing your order and always check any label or information supplied with the product before use or consumption.

3. Orders and how a contract is formed

3.1. Our acceptance of your order will take place when we send you an order confirmation email, at which point a contract will come into existence between you and us.

3.2. If we are unable to accept your order, we will inform you and will not charge you for the product, or we will refund any payment already made. This may be because a product is out of stock, because we have identified an error in the price or description, because we cannot meet a requested delivery date, or because we suspect fraudulent or unauthorized activity.

3.3. You are responsible for ensuring that the details you provide when placing an order are complete and accurate.

3.4. We reserve the right to refuse any order at our discretion.

4. Price and payment

4.1. The price of the products will be the price shown on the order pages when you place your order.

4.2. Delivery charges, where applicable, will be shown to you during the checkout process before you confirm your order.

4.3. We take reasonable care to ensure that prices shown on the site are correct. However, if we discover an error in the price of a product you have ordered, we may contact you for instructions before accepting your order, or reject your order and notify you of this.

4.4. Payment must be made in full before dispatch or delivery, unless we have agreed otherwise in writing.

5. Delivery

5.1. We will aim to deliver your order to the address and on the date or timeframe selected by you, but all delivery times are estimates unless we have expressly agreed a guaranteed delivery service.

5.2. Delays may occur due to events outside our reasonable control, including courier delays, severe weather, traffic disruption, stock issues, or circumstances affecting food preparation or transport.

5.3. You must ensure that someone is available to receive the order where this is necessary.

5.4. Risk in the products passes to you when the products are delivered to the delivery address you gave us.

5.5. Ownership of the products passes to you once we have received payment in full.

6. Your consumer right of return and refund

6.1. If goods are not fit for consumption on delivery, please contact us immediately at info@jbhalal.co.uk. You must not consume any product that you believe is unsafe, not at the correct temperature, damaged, contaminated, or otherwise not fit for consumption. If in doubt, do not consume the product and contact us immediately.

6.2. Many of the products sold on our site are perishable or are liable to deteriorate or expire rapidly. For those products, the usual right to cancel simply because you have changed your mind may not apply.

6.3. Where products are non-perishable and your statutory cancellation rights apply, you may cancel within the applicable legal period, provided the products are unused and in a resaleable condition, unless an exception applies.

6.4. Because some orders are prepared specifically for your requested delivery date, if you need to cancel an order for perishable or made-to-order products, please contact us as soon as possible. Where you contact us more than 48 hours before the scheduled delivery date, we may, at our discretion, agree to cancel and refund all or part of the order.

6.5. Nothing in these terms affects your legal rights as a consumer in relation to products that are faulty, unsafe, not as described, or not fit for purpose.

6.6. If you have returned a product to us because it is faulty, unsafe, damaged, or misdescribed, we will refund the price of that product and, where appropriate, any applicable delivery charges or reasonable return costs.

6.7. Unless the product is faulty, unsafe, or not as described, you are responsible for the cost of returning products to us, or for the cost of us collecting them from you where collection is agreed.

6.8. You must take reasonable care of any products while they are in your possession.

6.9. Any refund will be made using the same payment method used to place the order, unless we agree otherwise.

6.10. We may ask for photographs, batch information, temperature information, or other reasonable evidence before processing a claim relating to damaged, unsafe, incorrect, or missing goods.

7. Our right to cancel

7.1. We may cancel a contract for a product at any time by writing to you if:
(a) you do not make payment when due;
(b) you do not provide us with information that is necessary for us to supply the products;
(c) delivery to your address is unavailable or impracticable; or
(d) an event outside our reasonable control prevents us from fulfilling the order.

7.2. If we cancel your order under this clause after you have paid, we will refund you for any products not provided.

9.2. We are responsible for losses you suffer that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill, but we are not responsible for losses that are not foreseeable.

9.3. We only supply products for domestic and private use unless expressly agreed otherwise. We are not liable for any business losses, including loss of profit, loss of business, business interruption, or loss of business opportunity.

9.4. Nothing in these terms affects your statutory consumer rights.

10. Website use

10.1. All content on this site, including text, graphics, logos, images and software, is owned by us or licensed to us and is protected by intellectual property laws.

10.2. You may use our site only for lawful purposes. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other malicious or technologically harmful material.

10.3. We may suspend, withdraw or restrict the availability of all or any part of our site for business or operational reasons.

11. Other important terms

11.1. We may update these terms from time to time. The terms in force at the time you place your order will apply to that order.

11.2. Each paragraph of these terms operates separately. If any court or relevant authority decides that any paragraph is unlawful, the remaining paragraphs will remain in full force and effect.

11.3. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you, that will not mean that you do not have to do those things and it will not prevent us taking steps against you later.

11.4. These terms are between you and us. No other person shall have any right to enforce any of these terms.

12. Governing law and jurisdiction

12.1. These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales.

12.2. If you live in Scotland or Northern Ireland, you may also bring proceedings in your home jurisdiction where applicable.
